Auctioneer:
Virginia Ann Chapin, Auctioneer #7309,has been the Annual TABA Racehorse Sale auctioneer since its inception in 1997. In a four year period, Virginia presided over the sale of more than $2.5 million worth of horses and livestock. In a typical recent year, she moved 3,500 horses. A great deal of her business was transacted at the Huffman Horse Center, but Virginia has traveled throughout the Southwest and as far away as Wisconsin to exercise her considerable talents. Trained by Walter Brittan, the renowned auctioneer from Bryan-College Station, she has learned to quickly analyze the bloodlines and confirmation of the horses before the sale and describe these features in understandable terms for both laymen and connoisseurs. She expanded her capabilities by completing the curriculum at the Kansas City Auctioneers School and is continuing to sharpen her performance by attending the Certified Auctioneers Institute at Bloomfield, Indiana. She surrounds herself with a cracker-jack auctioneering team - a team that works smoothly together to maintain the pace of the auction, identify potential buyers and accurately record all pertinent sales information.

History of the TABA Sale
The Original Racehorse - The Arabian Horse
The Arabian horse dates back to the time of the Egyptian pharaohs. Their roots in present-day horse racing can be found in the foundation sires of today's Thoroughbred, most notably the Godolphin Arabian. The "original racehorse," the Arabian horse, is the focus of the annual Arabian racehorse auction offered to the public by the Texas Arabian Breeders Association (TABA).

Organized in part to help assure Arabian horses their rightful place in Texas horse racing, the Texas Arabian Breeders Association was formed in 1988, led by long-time Polish Arabian horse breeder, Joe Cassel. Many of those making up the first TABA Board of Governors had made certain that the Texas Racing Act of 1987 included Arabian horses as a racing breed, along with the Thoroughbred and Quarter Horse. This legislation guaranteed these racing breeds the right to race on all Texas pari-mutuel horse racing tracks. Arabians enjoy year around racing opportunities at three Class 1 horse racing tracks in Texas: Sam Houston Race Park, Retama Park and Lone Star Park at Grand Prairie.
TABA's main job as an organization is to act as the liaison between the Texas Racing Commission, the racetracks and the other racing breed organizations. No less important is TABA's job of managing and promoting the Accredited Texas-Bred program, which has proven very lucrative for breeders and owners alike. In keeping with the responsibility of promoting the Accredited Texas-Bred program, TABA also promotes Texas Arabian horse racing itself. This commitment is clearly illustrated in the results of the annual TABA Racehorse Sale.
Success of the TABA Sale
The greatest success of the TABA Sale is bringing new and first-time Arabian racehorse owners into Texas. In prior years, new owners have increased the numbers of racing Arabians in Texas which translated into fuller fields and more races. This is due to the fact the sale has produced good, and even great, racehorses. The TABA Sale has produced an astounding 85+% money earners and over 20% stakes winners. In the recent few years, the sale has reflected a surge in breeder interest, with broodmares as top sellers. Last year’s high seller at $11,000 was Jumeira, by Monarch AH, with a foal at her side by Line Dancer.
The TABA Sale offers a very limited number of horses, and out of the sales have come many notable champions. For instance Royale Fanfare became a two-time Darley nominee as she earned over $165,000. 2005's star auction graduate, Nordik Star, has earned well over $100,000 to date plus two Darley nominations. And one of last year's graduates, NC Casey Jones has just earned top honors as a Darley nominee, one of the Top Five 3-Year-Old colts/geldings in the U.S. The Darley Awards are the Arabian racehorse industry's highest honor akin to the Thoroughbred racing industry's Eclipse Awards and are held annually.
The Reason To Be Here
TABA looks forward to its not-for-profit Arabian racehorse sale each year, and with it, renewing its successful promotion of Texas Arabian horse racing. The consignor is rewarded for placing a good value in a new owner's hands who will in turn help maintain full fields and produce good handles that will increase purses. All of us in racing contribute to this cycle. Successful auctions mean we all win.
TABA encourages all who own, want to own or are just curious about Arabian racehorses to attend this year's auction at Retama Park. Looking over the past successes of horses sold at the TABA Auctions, every participant is assured of enjoying the best quality horses anywhere.

Coggins Testing
All horses in this sale have been required to have been tested for Equine Infectious Anemia (Coggins Test). Tests to have been performed within six months of sale date.
Previewing Horses:
Sale horses may be galloped and/or worked Friday, April 4 AND MORNING OF SATURDAY, APRIL 5 for interested buyers. Interested buyers should set this up with the consignor prior to Friday morning.
Open barns from 10:00am on the morning of sale day.
Absentee Bids:
All absentee bids will be executed and are accepted subject to the "Terms and Conditions of Sale" printed in the catalog, including provision that each Absentee bidder has been registered for the auction. This service is free and confidential. Please note: TABA offers this service as a convenience to customers who are unable to attend the sale, and although we will make every effort, TABA will not be responsible for error or failure to execute the bids.

Phone bidders must indicate in writing on the Bidder Registration Card names of horses on which they may choose to bid. Phone bidders MUST PROVIDE the phone number where they can be reached at bidding time. Phone bidders must be available at that phone number from 1:00 when the auction starts until the close of bidding. TABA must receive all phone bidding pre-registration information by Thursday, April 3, 2008.

Sealed Bids:
If you are unable to attend the auction in person or unable to bid by phone and wish to place bids, you may give TABA's auction bid committee instructions to bid on your behalf. A TABA representative will then attempt to purchase the lot or lots of your choice for the lowest price possible, and never more than the top price you indicate. Sealed bids MUST be received by TABA no later than Thursday, April 3, 2008. Bidder Registration Card MUST be received in addition to sealed bid.

When planning days for your stay, please note: the auction is Saturday, April 5, 1:00pm. Sale activities begin April 4 as horses arrive. The auction should be completed by 4:00pm, Saturday, April 5, but most people will make plans to stay later for after-sale fun and for making arrangements for their new horses!

Care of Horses After the Sale:
Care and feed for horses is provided until noon the day following the purchase. Please be reminded that title passes at the fall of the hammer, at which time the purchaser assumes all risk and responsibility for the horse. All horses must be removed from the sales premises in a timely fashion, and no later than 12:00 noon, Sunday, April 6. If the buyer fails to cause the horse to be removed at this time, the Consignor or TABA or their agents may cause the horse to be removed from the sale premises at the buyer's risk and expense.

Stable Release:
In order to remove a horse from the grounds, you must obtain a Stable Release from the sales office. Please confirm that the release you obtain represents the correct lot number. Also, be sure to give the release to the person ultimately responsible for removing your horse from the grounds. Buyers are cautioned not to lose these forms.
Transportation and Insurance:
Buyers will be responsible for attaining an insurance binder if desired and arranging transport of the horses they purchase.

Terms and Conditions of Sale
First - Applicable Law:
All horses included herein are offered for sale according to the laws of the State of Texas. The conditions of sale, as amended by any posted notices or oral announcements by the Auctioneer prior to or during the auction, constitute the entire agreement between the Consignors (the "Consignor") on the one hand and the bidders at the auction on the other hand. The Texas Arabian Breeders Association ("TABA") is acting solely as auction management in the capacity of an independent contractor for the Consignor.
Second - Warranty of Title and Possession:
Consignor has warranted that the Consignor has legal right to convey good and unencumbered title to the horse(s). Consignor warrants that upon a horse's sale and payment of the full purchase price, Consignor shall deliver title and possession free of any liens, claims or encumbrances whatsoever.
Third - Warranty of Pedigree and Registration:
Consignor warrants the horses's pedigree and registration as represented in the Consignor's Contract.
Fourth - No Other Warranty:
There is no warranty expressed or implied by the Auctioneer, TABA or Consignor as to the racing soundness, breeding status, breeding qualities, fertility, merchantability or fitness for any particular purpose of any horse offered in this sale. All horses are sold "As Is" and with all defects except only as expressly set forth in these conditions of sale. Buyer is bound by all announcements from the auction stand. Neither the Consignor, TABA, Auctioneer, nor any other person is authorized to make representations or warranties about any horse. No oral or written statement constitutes a warranty and such oral or written statements other than those contained herein, shall not be relied upon by any bidder or Buyer and are not part of any contract of sale.
Fifth - Right to Inspect:
The potential Buyer may have any horse examined by a veterinarian of his choice prior to the sale until 11:00 a.m. Saturday, April 5, 2008. Buyer acknowledges that he had the opportunity to inspect and examine by veterinarian or otherwise each horse he has purchased and accepts any horse he purchases with all conditions and defects except those which are specifically warranted in these conditions of Sale. This right given to a potential Buyer is given in lieu of any warranty of quality, condition or otherwise. Buyer further acknowledges that he has had the opportunity to inspect the pedigrees, racing records, eligibility for incentive programs, engagements and similar matters, breeding status, produce records and health and immunization records as represented by the Consignor.
Sixth - Catalog and Announcements:
Horses catalogued in this sale are offered with their pedigrees, racing records, eligibility for incentive programs, engagements and similar matters, breeding status, produce reports and health and immunization records as represented by the Consignor, and TABA is not responsible for the accuracy and completeness of information provided. In case of error or omission, Buyer shall seek redress only from Consignor. While certain information may have been procured by TABA from third parties on behalf of Consignor, it is nonetheless solely the responsibility of the Consignor to verify accuracy of such information and to notify TABA of any correction prior to sale. All of the corrections made to the catalog at the time of the sale from the Auctioneer's podium shall supersede the catalog. Eligibility for stakes engagements, incentive programs and similar matters are as of the date of sale only and all payments of such eligibility which are due after date of sale are solely the responsibility of Buyer whose obligation is to immediately determine when such payments are due and to promptly notify the proper organization of new ownership to receive direct billing.
Seventh - Bidding Procedures:
The right to bid as provided under law is reserved for all Consignors unless otherwise announced. All bidders must be at least 21 years of age and be prepared to present written proof of age and identity. Unless waived by announcement, there shall be an upset price of $1,000 on any horse offered. If an opening bid of the upset price is not immediately forthcoming to the Auctioneer's call, the horse shall be deemed sold to the Consignor. Minimum acceptable increases in bidding are: $100 until the bid reaches $20,000 and $500 thereafter. The highest bidder recognized by the Auctioneer shall be the Buyer. Should any dispute arise between or among two or more bidders, the Auctioneer shall forthwith adjudicate the dispute and his decision shall be absolute, final and binding on all parties. Bids received after the fall of the hammer are not grounds for dispute. Bids acknowledged by bid spotters employed by the Auctioneer are recognized as if tendered to the Auctioneer, but in case of dispute the bidding on the horse shall be forthwith reopened for advance bids and if there be no advance bid the horse is sold to the person from whom the Auctioneer recognized the last bid. In case of a dispute advance bidding shall be restricted to the contending parties, but should the recognized bid be reduced below the bid of commencement of dispute then the bidding is reopened to all bidders regardless of whether or not final bid exceeds the bid which was disputed. The Auctioneer reserves the right to reject any or all other bids. The Auctioneer's sale record is conclusive and is not subject to challenge.
Eighth - Buyer:
The highest bidder recognized by the Auctioneer shall be the Buyer who shall sign the Acknowledgment of Purchase immediately upon fall of the hammer. Right of purchase of the successful bidder, as determined by the Auctioneer, is not impaired in case of signing of Acknowledgment of Purchase by another bidder. Except as otherwise provided in these conditions, the person signing the Acknowledgment of Purchase shall be personally, joint and severably liable as the Buyer regardless of the manner in which the Acknowledgment of Purchase is signed or whether such signature indicates the Acknowledgment is signed as an agent and discloses the identity of a principal unless the agent has filed with TABA an approved Agent Authorization form for this sale and is not also listed on the Acknowledgment of Purchase as principal.
Ninth - Title:
Title passes to Buyer at the fall of the hammer at which time all risk and responsibility for the horse is assumed by the Buyer. Buyer agrees to release, defend, indemnify and hold TABA and the owners and/or operators of the facilities and their directors, officers, employees, agents and representatives harmless from all losses, damages, expenses, claims, causes of action, diminution of value or attorney's fees arising out of or related to the possession, care, custody, control or maintenance of any horse on which he or she is the successful bidder including but not limited to any claims arising out of injuries or damage caused by the horses after the fall of the hammer. The horse will be held for Buyer by Consignor until Buyer makes settlement as provided in the tenth condition below.
Tenth - Terms for Settlement:
The terms of the sale are cash. Buyer shall make settlement of the full purchase price for each horse purchase within thirty (30) minutes of the conclusion of the sale and shall pay TABA cashier the total purchase price (successful bid plus any applicable taxes and fees) by one or more of the following means: U.S. currency, cashier's check, wire transfer, Visa credit card, traveler's check or personal check subject to clearance prior to the release of the horse (collectively "Cash.") In no case shall any part of the total purchase price be paid directly to the Consignor by the purchaser. Such payment will not be regarded as valid and will not entitle the purchaser to obtain possession of the horse.
Eleventh - Consignor Commission:
Unless repurchased by Consignor, a commission of 10% of the successful bid price will be payable to TABA by Consignor from the proceeds of the sale contemporaneously with the payment of the successful bid price by the Buyer.
Twelfth - Delivery:
On final settlement for a horse, the cashier will issue a Stable Release Form which must be presented by the Buyer to the stable manager for delivery of the horse. Buyers are cautioned not to lose these forms. Taking possession of the horse by the Buyer or Buyer's Agent shall constitute delivery thereof. If the Buyer fails to cause any horse to be removed by 12:00 noon on Sunday, April 6, 2008, the Consignor or TABA or their agents may cause the horse to be removed from the sale premises at the Buyer's risk and expense.
Thirteenth - Default of Payment:
If any successful bidder fails to pay for the horse in the manner described above, the Consignor shall have at his option, in addition to all other legal rights, the right to (a) resell the horse, (b) bring an action for specific performance in which the defaulting Buyer agrees to pay all costs of such suit together with all reaso |
